Terms and Condition

5G Subscription Offer:

  • An advance payment of monthly fee and admin fee are required. The number of months of an advance payment, the extra data and/or free offers and/or the value of the premium depend on the contract subscription selected.
  • Each new customer will only be entitled to any welcome subscription offer once only.
  • Each designated contract subscription is entitled to the above offer once only. The Company reserves the right to offer an alternative gift of equivalent or approximate value. This offer cannot be used in conjunction with other subscription / re-contract offers.
  • The above offers will be forfeited if the customer changes to other service plans, and the Company has the right to charge the full amount of the gift without prior notice.

5G Student Plan:

  • Applicant must be aged 18 or above and a full-time student of designated post-secondary education institutions in Hong Kong. Designated post-secondary education institutions in Hong Kong include accredited universities in Hong Kong, Caritas Institute of Higher Education, Caritas Bianchi College of Careers, Centennial College, Chu Hai College of High Education, Gratia Christian College, Hang Seng University of Hong Kong, HKCT Institute of Higher Education, Hong Kong College of Technology, HKU SPACE, Hong Kong Nang Yan College of Higher Education, Tung Wah College, Vocational Training Council or Hong Kong Academy for Performing Arts. Also applicable to applicant aged 18 to 25 with valid overseas post-secondary education institutions student ID card. Valid student ID card and HKID card / Passport must be presented upon registration for the service plan. Each HKID no. or Passport no. can only subscribe to the Student Plan once.
  • Only applicable to new customers whose identity document (HKID or passport no.) has not subscribed any postpaid mobile service in the past 3 months.
  • An admin fee of HK$18/month and a fixed term contract are required. (if applicable)
  • Call duration is rounded up to full charge units for computation purposes. Each full charge unit is based on a per minute airtime charge.
  • Intra SMS is text SMS sent within Hong Kong to SmarTone customers and is subject to a monthly quota of 500 Intra SMS units ("Quota"). If the usage exceeds the Quota, the thereafter charge is HK$0.3 per Intra SMS; charge per Inter-network SMS is HK$0.6. Each SMS is calculated on 160 English characters or 70 Chinese characters basis. If your message exceeds this limitation, it will be transmitted in form of multiple SMS.
  • Roaming charge & standard roaming data charge apply when roaming. Please ask our store assistants or visit our website for details.
  • 5G service plans are not applicable to 2G phones/ connected devices or any phones/ connected devices which have manually opted for 2G network. If the customer uses this plan on any 2G phones/ connected devices or any phones/ connected devices which have manually opted for 2G network, any charges which may incur will be borne by the customer. Actual data transmission speeds may vary due to Internet traffic conditions, local conditions, hardware, software and other conditions which may arise.
  • Plans are not applicable to BlackBerry smartphones with BlackBerry 7 OS and earlier versions.
  • Plans cannot be used in conjunction with DataRoam Plan.

Unlimited Local Data:

  • Only available to customers who have subscribed to a designated 5G service plan contract subscription.
  • When monthly data usage reaches the plan's data allowance, data service continues with data speed up to 1Mbps / 5Mbps in 5G network, the thereafter data speed depends on the contract subscription of the service plan selected.
  • Unlimited Local Data is not applicable to 2G phones / connected devices or any phones / connected devices which have manually opted for 2G network, and not applicable to other connected devices (including but not limited to USB modem / pocket wi-fi / TV box / BlackBerry smartphones with BlackBerry 7 OS and earlier versions ).
  • Subject to relevant terms and conditions. Please refer to T&C-T344 / T&C-T365 for details.

Services Combo Offer:

  • Designated SmarTone Broadband Service customer can enjoy rebate of $18 per month under the Broadband service upon a contract subscription of a designated mobile service plan. The rebate period is equivalent to the contract period of the mobile service plan.
  • Upon the eligible SmarTone Broadband Service customer and the eligible mobile service plan contract subscription validated by the Company, the rebate will be credited upon service activation and after the cooling-off period of the designated SmarTone Fibre Broadband Service / Home 5G Broadband Service.
  • Designated SmarTone Broadband Service customer shall be the subscriber of the designated mobile service plan contract subscription to enjoy the Offer.
  • Total rebate/ remaining rebate will be forfeited if the customer terminates the mobile service plan or the Broadband Service. The remaining credit amount cannot be exchanged for cash or refund.

Smart Data Bank Service:

  • Any unused local data, extra local data, top-up data (exclude unlimited local data) and extra China and Macau data usage of free GBA data pack under designated 5G service plan ("Eligible data to be carried forward") before the end of bill month can be carried forward until change or cancel "Smart Data Bank" Service.
  • Maximum balance of data to be carried forward is limited to: 500GB for local data and 10GB for designated China and Macau data. Any unused and related eligible data to be carried forward before the end of bill month cannot be carried forward and will be forfeited if balance of data to be carried forward reach the limit.
  • (Where applicable) Upon the subscription of the specified 5G service plan with the "SmarT Data Bank" service plan, balance of data to be carried forward is shared by Main SIM card and all 5G Add-on SIM cards under the Plan.
  • Unused Eligible data to be carried forward before the end of bill month will not be carried forward if the Customer changes to other service plans; Balance of data to be carried forward will be forfeited if the Customer change or cancel "Smart Data Bank" Service.
  • Subject to relevant terms and conditions. Please refer to T&C-T346 for details.

Online Exclusive Offer:

  • Only available to customers who subscribe to the designated 5G Student Plan.
  • Only applicable to new customers / existing customers with a new subscription, and the subscription is made through SmarTone Online Store.
  • Customers can enjoy extra Double-up Local Data offer per month in the first 3 bill months within the contract period, the extra local data is equivalent to the local data allowance of the service plan at the time of subscription.
  • The extra local data under this offer will be forfeited if the Customer changes to other service plans.
  • The extra local data cannot be used in conjunction with DataRoam Plan.
  • Each service plan is entitled to the offer once only.

JOOX service:

  • This service can be used on smartphones running iOS 9.0 or above and Android™ 4.1 or above.
  • JOOX is owned and operated by Tencent Mobility Limited.

KKBOX service:

  • This Service can be used on supported devices, please click here to check the system requirement. For Android™ smartphone which does not support Google Play services, the ValueAdded Service will not be applicable on the smartphone.

Hang Seng Credit Card Customers Offers:

  • The Promotion Period is from 1 January 2023 to 31 December 2023, both dates inclusive (“Promotion Period”).
  • The offers are applicable to Hang Seng Bank Limited ("Hang Seng") Customers who hold Hang Seng Credit Card or Affinity Card ("Eligible Credit Cards"). The offers are not applicable to Hang Seng UnionPay Renminbi Diamond Commercial Card, Reminbi Credit Card, USD Visa Gold Card, eShopping Mastercard®, Private Label Card and Spending Card.
  • Within the Promotion Period, upon the subscription of the designated service plan contract via SmarTone Stores or SmarTone Online Store, Customers are required to submit valid eligible student identity proof, settle the payment and pay the monthly fee and related service fee per month through Autopay set up with Eligible Credit Cards to enjoy the offers.
  • Offer 1: 5G Student Plan: Customers can enjoy special offer of free 15/20/35GB RoamFlex Data Pass (Asia Pacific) within the contract period upon subscription of a designated 5G Student Plan under fixed-term contract. The RoamFlex Data Pass (Asia Pacific) offer depends on the contract subscription selected. Only applicable to new customer whose identity document (HKID or passport no.) has not been registered for any postpaid mobile service with SmarTone in the past 3 months.
  • Offer 2: 4.5G Student Basic Plan: Customers can subscribe the designated service plan at a special monthly fee $68.
  • Subscription via SmarTone Online Store is available to Eligible Credit Cards only. If Customers choose Hang Seng UnionPay Credit Card for setting up Autopay to enjoy the offers, please visit SmarTone Stores to make the subscription.
  • The above offers will be forfeited if the Customers discontinue to use Eligible Credit Cards for Autopay after enjoying the offers or if the Customers change to other service plans, and the Company has the right to charge the full amount of the offers already enjoyed without prior notice.
  • The offers depend on the contract subscription selected. Each designated contract subscription is entitled to the above offer once only.
  • The Company reserves the right to make an alternative offer of equivalent or approximate value. The offers are not transferable, and cannot be redeemed or exchanged for cash, other products or discounts, and cannot be used in conjunction with other promotional offers, discounts, coupons, cash coupons or other subscription / re-contract offers (unless otherwise specified).

RoamFlex Data Pass service plan:

  • The free RoamFlex Data Pass is calculated based on the original monthly fee HK$28/HK$36/HK$48, after a rebate of HK$28/HK$36/HK$48 per month has been given to the customer within contract period.
  • The Customer shall use the RoamFlex Data Pass with Term total 24 months. The Term shall start from the service effective date.
  • On subscription of the RoamFlex Data Pass service plan, roaming data allowance and top-up of RoamFlex Data Pass data purchased under the RoamFlex Data Pass service plan within the contract period can be shared in designated destinations.
  • The Customer who subscribe RoamFlex Data Pass should also activate Data Roaming Day Pass or "Upgraded" Roaming Data Day Plan at the same time. Please click here for details of Data Roaming Day Pass. Please click here for details of "Upgraded" Roaming Data Day Plan.
  • The remaining data entitlement of the RoamFlex Data Pass will be automatically forfeited after the Term expired. The new data allowance within contract period of RoamFlex Data Pass will be provided after the new Term / extended Term effective.
  • When the Customer is within the location of designated destinations and if the Customer’s accumulated RoamFlex Data Pass usage exceeds roaming data allowance within contract period and (if applicable) top-up of RoamFlex Data Pass data purchased, the Customer will be charged the original day plan price of Data Roaming Day Pass or "Upgraded" Roaming Data Day Plan subscribed by the customer and according to the destination(s) for the thereafter roaming data usage.
  • When the Customer is within the location of any of the overseas destinations other than designated destinations, the daily roaming data usage will be charged with the original day plan price of Data Roaming Day Pass or "Upgraded" Roaming Data Day Plan subscribed by the customer and according to the destination(s).
  • RoamFlex Data Pass cannot be subscribed in conjunction with China Macau Data Pack or Greater Bay Area Easy Pack.
  • (If applicable) If the Customer purchased more than one Roaming Data Pass for different group destinations, deduction on usage of roaming data shall follow the following deduction sequence:
    1) Roaming data allowance under service plan (DataRoam Service/ Greater Bay Area Data Service/ ExtraCare Bay Area Plan/ SuperCare Bay Area/ Asia/ Worldwide Plan);
    2) RoamFlex Data Pass roaming data allowance;
    3) Roaming Data Pass (by daily);
    4) Data Roaming Dollars.

Greater Bay Area Data Service:

  • Only applicable to customers with subscription of a designated 5G Student Plan (30GB/50GB/100GB) under fixed-term contract.
  • Greater Bay Area Data Service monthly data allowance can be shared in China and Macau.
  • The Customer who subscribe Greater Bay Area Data Service should also activate Data Roaming Day Pass or “Upgraded” Roaming Data Day Plan at the same time. Please click here for details of Data Roaming Day Pass. Please click here for details of "Upgraded" Roaming Data Day Plan.
  • When the Customer is within the location of China and Macau and if the Customer's accumulated Greater Bay Area Data Service data usage exceeds monthly data allowance and (If applicable) the data allowance carried forward, the China Macau data service will be charged automatically by Data Roaming Day Pass or "Upgraded" Roaming Data Day Plan subscribed by the customer.
  • When the Customer is within the location of any of the overseas destinations other than China and Macau, the daily roaming data usage will be charged by Data Roaming Day Pass or "Upgraded" Roaming Data Day Plan subscribed by the customer.
  • Greater Bay Area Data Service cannot be used in conjunction with specified DataRoam services or designated Roaming Data Plan.
  • If Macau 1 Card 2 Numbers customer subscribe Greater Bay Area Data Service, data entitlement of Macau under Macau 1 Card 2 Numbers will be forfeited.
  • Our company reserves the right of final decision related to these offers and to change the Terms & Conditions without prior notice. Subject to relevant terms and conditions. Please refer to T&C-I041 for details.

Anytime Music Service:

  • Only applicable to customer who has subscribed to the designated Student Plan.
  • Customer opting for "Anytime Music" service, the contract end date will be the same as the designated Student Plan. (if applicable)
  • The available designated music streaming apps will be updated and amended from time to time. Please ask our store assistants or visit the Company website for details.
  • The designated music streaming apps are provided by a third supplier. The content and the settings of those apps may change from time to time without any notice. The Company makes no representation or guarantee as to the quality and availability of the services or information provided by the third suppliers.
  • Subject to relevant terms and conditions. Please refer to T&C-T316  for details.

Talk Freely Pack Service:

  • Only available to customer who has subscribed to a designated Service Plan.
  • The available designated apps will be updated and amended from time to time. Please ask our store assistants or visit the Company website for details.
  • The designated apps are provided by a third supplier. The content and the settings of those apps may change from time to time without any notice. The Company makes no representation or guarantee as to the quality and availability of the services or information provided by the third suppliers.
  • The Talk Freely Pack Service Plan does not include the subscription fee and other items / service purchased by the designated apps.
  • (If applicable) Upon the subscription of the designated Family Service Plan / designated 5G service plan with the Talk Freely Pack Service Plan, all mobile numbers under the Plan can enjoy the Talk Freely Pack Service.
  • The local data speed under the Talk Freely Pack Service Plan follows the Specified Service Plan subscribed by the Customer.
  • For any Customer who subscribes the Specified Service Plan with a designated data speed, when monthly local data usage reaches the specified data usage under the Specified Service Plan, local data service of the Specified Service Plan and the Talk Freely Pack Service Plan continues but data speed will be at up to the designated data speed under the Specified Service Plan, data service experience may be affected.

eDoctor Video Consultation for Family:

  • This service is only available for SmarTone Customers with designated mobile monthly service plan subscriptions.
  • SmarTone customers with designated mobile monthly service plan may enjoy first 6-month free trial for the first time subscription. Unless otherwise receipt of notice of cancellation by the Customer, the relevant service will continue to be provided to the customer after the expiry of the free trial offer, and the monthly service fee of the Standard Plan will be charged. If the customer cancels subscription of the service, please call SmarTone Customer Services Hotline prior to the end day of the free trial period.
  • The 6-month free trial is based on the original monthly fee HK$48 for the service standard plan, after a rebate of HK$48 per month has been given to the customer for the first six months.
  • Monthly fee rebate offer cannot be used in conjunction with other offers.
  • The data waiver is only applicable to the local data usage incurred by the MyCigna HK App‘s video consultation part only on smartphone using SmarTone mobile network. Data usage incurred by apps download and software update are excluded. When the monthly local data allowance of the designated service plan has been fully consumed and the data service is suspended, this data waiver will also be suspended until next bill month and will only be resumed once the Customer purchases data top-up options. Standard roaming data charges will apply while using the service abroad. If the customer has applied for a Roaming Data Pack, data will be deducted from the plan. Gamergizer:

  • The Service is only available Customer who has subscribed to a designated 5G Service Plan.  The add-on SIM under the designated 5G Service Plan can also subscribe the Service individually.
  • During the service period, more network resources will be allocated, and network usage will be prioritized to the local data entitlement of Specified Service Plan and extra top-up local data.
  • The Service is only available to the local data entitlement of Specified Service Plan and extra top-up local data, but not suitable to “FUP Unlimited Data Plan”
  • At the end of this contract, the Company will continue to provide the service and the customer will be charged at the prevailing rate.
  • Subject to relevant terms and conditions. Please refer to T&C-T345.

Handset and Accessories Credit Offer:

  • Customer can enjoy $1,200 Handset and Accessories Credit Offer once upon a contract subscription of a designated 5G Student Plan contract.
  • A prepayment of designated amount is required. The prepayment amount varies according to the service plan selected by the customer. Prepayment amount will be credited to the customer during the contract period according to the credit arrangement specified in the Sales and Services Agreement (or Supplemental Agreement to the Sales and Services Agreement).
  • Only applicable to the purchase of designated smartphones, accessories and phone protection services at the Company's stores.
  • Customer is required to purchase designated smartphones, accessories and phone protection services at the prevailing Recommended Retail Price.
  • The credit is valid for 365 days from the date of contract subscription. Customer can use the credit offer for one transaction only within the validity period, any unused credit will be forfeited upon expiry.
  • The remaining credit amount cannot be exchanged for cash or refund.
  • Each designated contract subscription is entitled to the credit offer once.
  • Customers who purchase the designated smartphones can enjoy 12 months' Upgraded Back-to-Front "SmarTone Screen Replace™".
  • The available smartphones, accessories and handset protection service will be updated and amended from time to time. Please ask our store assistants for details.

Upgraded Back-to-Front SmarTone Screen Replace™:

  • SmarTone Screen Replace™ is provided by Avo Insurance Company Limited and Sun Hung Kai Properties Insurance Limited (collectively "Avo").
  • Upon accidental physical damage of the designated Smartphone/Wearable devices screen and/or its back cover, Avo will reimburse the cost of screen/ back cover repair or replacement, once only within the first 12 months from the effective date of Screen Replace. The reimbursement is subject to submission by the customer of the official invoice (must include the IMEI number of the device) from the manufacturer or its authorised repair centres as stipulated by Avo. The maximum amount of the smartphone reimbursement is HK$3,000 per claim. The maximum amount of the wearable device reimbursement is HK$1,500 per claim.
  • The reimbursement is restricted to covering the repair or replacement cost of accidental physical damage of the designated handset/Wearable devices screen as well as back cover, and expressly excludes any other repair and refurbishment of any other component or the handset itself. If the manufacturer or its authorised repair centres, as stipulated by AVO, offer a replacement as the only option for repair, Avo may exercise discretion and will reimburse up to 60% on the cost of replacement, subject to the maximum limit per device. The reimbursement percentage can vary from time to time and Avo's decision on the validity for reimbursement is absolute and final.

SmarTone Plus membership & privilege:

  • Customers who subscribe or renew designated mobile service plan will enjoy SmarTone Plus membership and the membership offered depends on the service plan selected. Membership period of designated membership tier will be 13 months.
  • For members who have met the qualifying spending level during the eligible spending period, their membership will be renewed or upgraded.
  • Fixed-term contract is required for designated membership tier.
  • SmarTone Mobile Communications Limited may terminate or change the terms and conditions of SmarTone Plus at any time without prior notice.

  • Monthly fee HK$128 is based on the original monthly fee HK$168 for 5G Student Plan, after a rebate of HK$40 per month credited to the customer during the contract period. After expiry of the contract, the customer will be charged at the prevailing comparable plan if the customer continues to use the service. Unlimited Local Data: The customer can enjoy 1Mbps unlimited data offer per month during the contract period. 1Mbps unlimited data Service Rebate: Subscription to 1Mbps unlimited data is required within the contract period. Customer can enjoy a monthly rebate for 1Mbps unlimited data under a designated Plan, the amount of rebate is based on the monthly service charge at the time of service subscription. The rebate on the first bill month and/or the last bill month will be credited on a pro-rate basis based on the number of days of usage during the bill cycle (If applicable). The rebate amount in a bill month will not be greater than the monthly service charge. After the expiry of the contract, 1Mbps unlimited data will be terminated.

  • The free Greater Bay Area Data Service is calculated based on the original monthly fee $87, after a rebate of $87 per month has been given to the customer within contract period.

  • The free RoamFlex Data Pass is calculated based on the original monthly fee $28, after a rebate of $28 per month has been given to the customer within contract period.

  • When monthly data usage reaches the plan's data allowance, data service continues with data speed up to 1Mbps / 5Mbps in 5G network, the thereafter data speed depends on the contract subscription of the service plan selected.

  • Administration Fee Waiver Offer: Customer can enjoy Administration Fee Waiver offer starting from the first bill month within the contract period when he/she successfully port-in from other mobile operators; the period between service activation day and first bill day will be charged on a pro-rate basis based on the original charge. Administration Fee Waiver offer is calculated based on the original HK$18 per month, after a rebate of HK$18 per month has been given to the customer within the contract period. At the end of the rebate period, the customer will be charged at the prevailing Administration Fee if the customer continues to use the service.

  • Thereafter charge for local data HK$30/5GB or HK$80/5G Unlimited Data (data speed up to 5Mbps) will be charged on 'Advise and Consent' basis. 'Advise and Consent' basis: At any time when the local data usage on a plan nearly reaches the monthly allowance, an SMS notification will be sent to the customer. The customer may reply to the SMS to purchase a top-up that will be valid until the end of this bill month. If no top-up is purchased, data service will be suspended when the data usage has reached the allowance. Customer may purchase a top-up at any time to resume service, or wait until the beginning of the next bill month to commence service again with the new monthly data allowance. (if applicable)

  • Fixed-Term contract is not required for Smart Data Bank; customers are required to pay service fee monthly. Monthly fee HK$18 of "SmarT Data Bank" is calculated based on the original monthly fee HK$88 for "SmarT Data Bank", after HK$70 per month has been given to the customer within the contract period of specified 5G Service Plan. At the end of the contract, the customer will be charged at the prevailing comparable plan if the customer continues to use the service.

  • Other services included: 500 Intra SMS, voicemail, call forwarding, caller number display, call waiting and conference call.
